Is CBD legal in Florida ? Yes, although retailers and manufacturers alike need to follow some strict guidelines, in addition to being properly licensed.
What lead to CBD becoming Legal in Florida
Following the guidelines set forth by Federal Law in the 2018 Agriculture Improvement Act, better known as the 2018 Farm Bill, which allowed at the Federal level legalizing CBD to include, the manufacture and sale of hemp extracts including CBD oils, as long as they contained a total delta-9 tetrahydrocannabinol (THC) content of less than 0.3% on a dry weight basis.
In January of 2020 the Florida Department of Agriculture and Consumer Services also know as FDACS for short, became authorized to regulate by issuing food permits for the manufacturing, processing, packing, holding, preparing or selling of food consisting of or containing hemp extract and CBD both at wholesale and/or retail.
This fell under the umbrella of the Division of Food Safety. This effectively made any hemp extract for human ingestion subjected to the strict standards of food safety set by the State. Although stringent, this made extracts manufactured out of the State of Florida one of the most reliable and accountable in the nascent and traditionally largely unregulated hemp extract/ CBD industry. After all, to buy CBD products are not FDA approved.
This standard set by Florida’s CBD program included the strict testing requirements, adhering, if not surpassing the USDA/ ISO 17025 lab test standards. The State’s CBD Hemp program requires that all hemp extracts contain a QR code on each product linking to the independent third party lab test which insures potency, no heavy metals, no pesticides, amongst other test for quality.
Later that year (April 2020) Florida started to issue Hemp Cultivation permits. Given that hemp/CBD products are legal in the State of Florida, there still remains plenty of confusion and misconceptions. The hemp CBD industry is tainted with many bad apples trying to make a quick buck.

What to look for in Legal Florida CBD Products
As a consumer there are several factors you should consider when purchasing Florida CBD products. First you want to make sure that the company you purchase from is licensed by the Florida Department of Agriculture. This means that any retail establishment needs to have this license. If they hesitate in showing you their license and/or say they are exempt, BEWARE!
The second thing you need to look for in a reputable CBD legal company in Florida is the presence of a QR code. Each product needs to have a scannable QR code which links to its lab test. If your product does not have it, then BEWARE! If it does have a QR code, make sure that it is a full hemp panel test.
A full hemp panel third party lab test must contain analysis of Potency, Heavy Metals, Mycotoxins, Pathogenic Microbiology, Residual Solvents, and Pesticides. Again, if this is not in your lab report, BEWARE!
